In California, spousal support - also known as alimony - is meant to provide financial assistance to a former spouse. The primary intent is to enable a former spouse to enjoy the same standard of living that he or she had during the marriage. Over time, alimony can allow the receiving spouse to have the financial means to learn skills or obtain education to become self-supporting.
Many factors go into deciding the amount of spousal support, such as the following:
- The length of your marriage
- The needs or the requesting party
- The requesting party's ability to earn income
- The paying party's ability to pay and / or ability to afford the spousal support
- Standard of living for the couple prior to the termination of marriage
Spousal support can be ordered temporarily or permanently. You and your former spouse can reach a mutual agreement on spousal support amounts, but if a decision cannot be reached, the court may see fit to intervene and make the decision on your behalf. Modifying Your Spousal Support Order
It is fairly common in divorce cases for spousal support or alimony to be part of the proceedings. Whether spousal support is ordered or not, and to what extent, will depend upon a number of factors, including the couple's standard of living prior to the divorce, income levels, any extenuating circumstances which would prevent one individual from being able to adequately provide for themselves, and other facts.
While these decisions are always carefully deliberated and assessed before being made – in our state, we actually have a formula used to calculate spousal support – it is possible for circumstances to change significantly in the years that follow divorce. If a prior arrangement is no longer effectively serving its purpose, it may be time to pursue a post-judgment modification.
