child support and custody question?

My daughter is 4, her father and I were never married. We are no longer together, I live with my daughter in a house with my parents and two younger siblings. He lives with his parents. I’m 22 he’s 23. When we split we made a verbal agreement about when she would visit him and how much he would pay me each week. She would stay with him Tuesday nights and Friday night or Saturday Morning to Sunday evening. And he would pay me 50 a week. We’ve kept this up, but now he is pushing for her to be taken to Fl with his parents during Christmas when we already had an agreement about Christmas. I said no and all he keeps saying is we’ll see.
Yesterday a friend who works with his sister told me that she, him and their parents have gotten their passports and that my ex had went and gotten a copy of my daughters birth certificate. This friend also told me that my ex’s sister was asking about custody and child support and talking to family law lawyers.
I’m afraid they might try to take her from me and/or out of the country. They are from mexico. Today I went and filed for court ordered Child Support. When or how long will it take for him to be notified that I did this? I’m also trying to get a lawyer so that I can try to get custody of my daughter before they try to because they have more money than I do.
I just went and filled out the application today at dss. I dont know who’s serving him. I have to go back in two to three weeks

What important things need to know about getting a divorce?

My relative (female) is going through a divorce. She lives in California. She has no clue how to handle it as far as the procedures and things that she should look out for in terms of financial and getting the child support (2 small kids). Should she get a divorce lawyer? The main concern is she has no job and she worries not be able to afford to hire a lawyer. Please give some advice.

I have been separated from my husband for 5 yrs now,we have 2 kids the first 6 months of the separation was due to domestic violence against me so the judge ordered supervised visits for him ,gave me temp custody and made him pay child support for 6 months and told us both to get attorneys to handle it after that well we never did he paid the support for 6 months and then it got sporadic until he met his now girlfriend and he has not paid support in 4 yrs but i still let him see the kids if and when he did show up because they loved him sometimes he would not call or show for months,he has been homeless through ten jobs and now has 2 babies to care for w/ new gf well this spring break after he knew I spent all my tax money on getting my kids new beds and clothes because he doesn’t support them he ask if he could get them for the week so I said yes he said they would be in town at his sister well the next day dss showed up to investigate me for being on drugs and a pigstye house well they saw my house was spotless and I passed my test well he has taken them 5 hours away same st s.c. away gotten an attorney has them out of school they are all honor students and wont let me have them back,the one time he did let them call they begged me to get them , I have no money for a lawyer I pay my bills and have raised this kids on my own I make to much for legal aid forty dollars to much but not enough money to give a lawyer thousands of dollars and yes I did call and beg and all i hear is sorry we cant help please some one tell me how to fight this I also have 2 older kids 12 and 14 i don’t know where he has them I am helpless and desperate the law says we are both custodial parents and decide in court but they have lived w/ me for 5 yrs and he just ups and takes them

They are 6 and 7,social services is on my side but we cant find him to serve him with truancy papers much less anything else,I called every family law lawyer they all say it cost any where from three to five thousand…………. thanks for the support but I think it is going to take a miracle at this point

How to file for divorce when someone other than parents has custody of children?

I have a friend whom is wanting to do a do-it-yourself divorce. Him and the ex have two boys ages 8 and 9. The maternal grandmother has full legal custody of the boys and lives in Nebraska. Divorce will be in Kentucky. The grandmother left KY and moved to Nebraska. My friend already pays child support to the maternal grandmother. So his question is since neither parent has any rights to the children do the children still need to be listed in the divorce? Thanks.

Need to hire a lawyer to get married..whom should we hire?

We both are non resident aliens (foreigners working but dont have permanant residency here). We are from India, and have been raised in different religions.

We need to hire a lawyer who can get us legally married, which would be recognized both here and back home.

I have been trying to find a lawyer who provides such kind of service, but all I see are divorce, family law, adoption, child support etc lawyers. Which kind of lawyer should we approach?

Isn't it illegal to use a lawyer's name on a letter as if the lawyer wrote it?

I received a letter, that was put on my door from a rental company (that’s known for illegal acts) trying to retrieve furniture rented by my 65 year old grandfather. Well on the letter it states that he would face jail time. Well as I look closer at the letter, which was a copy by the way, some thing were whited out. And they put my grandfather’s name in the place of it. It also says "certified mail"…it didn’t come in the mail the company stuck it in our door. Another strange thing about it, the date on the letter says August 5, 2009, even the stamp says so. My grandfather’s bill was not due until August 15, 2009. And to top it off, I researched the lawyer, she does Family Law….divorced, child support….has nothing to do with renting furniture. So they just used one of their documents they already had and white out stuff, used this lady’s name and threatened my grandfather with jail for being 12 days late after he had been paying them over a year. So what should I do? Contact the lawyer and let her know? My grandfather has mild alzhiemers (sp?), and was scared thinking he is going to jail. I’m furious!!!! Oh and I forgot to mention, they also made up a false dispossessery writ or possession…..with a false case no, and not to mention that that’s used for landlord/mortgage/tenant type of form.

My husband had a girlfriend who became pregnant and lied to him and told him the child was his. He signed the birth cert, but was told immediately after the girl’s birth that she wasn’t his, and they broke up. Young, uninformed, and not able to afford a lawyer, he didn’t do anything about it. She is now 13 years old. For the first few years, he paid child support as ordered, but then stopped paying. His wages were being garnished for the close to K bill that added up. Finally, a friend helped him file the forms needed to reverse this mess after he had a DNA test that proved she wasn’t his. Child support lowered his amount to K, but they refuse to remove this, as this is not child support, but basically from when the mother went on welfare. He has a court date in a couple of months for a hearing to fix this. They froze his bank account yesterday and seized about K. Will he ever get this money back? What about anything the IRS took after the paternity test? (in MA)

Legal Advice Please Family Law?

I am going to write this in my boyfriends point of view to make it easier understood.
I plan on getting a lawyer, but hoping this can help till I get in to see one. It’s been racking my brain.

SITUATION
About two weeks ago, my ex called me up and told me that she was going to drop my daughter off at DCF if I didn’t come and get her cause she no longer had a place to stay. I called my mother up (I am a truck driver and wouldn’t be back for about 4 more days) and asked her if she could go get my daughter. Well, my ex found money to bring her down and my mother gave her money to get back home (ex lives in Iowa, we live in Missouri). Well, my mother and step-father typed and printed out a temporary guardianship paper for my ex to sign. I have not seen it but it is so my mother and step father have temporary guardianship over my daughter and there is no date set for it to end. My ex signed it without reading it. My name is not on it. My ex and I were never married. I do pay child support, which was established in Illinois in 2003. There was no custody deal set up. The only thing that was set up was that neither of us could leave state with my daughter without permission from the other. Well, my ex did it anyway. Anyways, my mother seems to be pulling something squirrelly and I don’t know what it is. I went and got my daughters birth certificate, and she keeps trying to get it from me. She said that since she has temp custody, I can’t even get my daughter into school or take her to doctor cause she has custody, not me. I have been planning on fighting for my daughter for a while now, just been waiting to get out of the truck in order to do it. I am moving into my own place in a couple of days, and I am worried that my mother isn’t going to let me take my daughter.

QUESTIONS:
How legal is that temp guardianship thing that my mother had my ex sign?
Where am I on this whole deal?
If it is legal, how do I fight it?
