Divorce- What comes first the divorce or the settlement? Australian Family Law?

What I am trying to find out is, do I need to settle on an agreement to financial/asset splitting before the divorce is granted or can it be done after?

The reason being to cut a long story short, my wife is being very difficult regarding the splitting of assets, stating a higher amount, etc, etc.

She is deliberately trying to stall the divorce as long as possible as she knows my current relationship is working out quite well, could be an act of jealousy.

Anyway, if someone has been there, done that, I would love to hear before I take the plunge into expensive lawyers.

What is the easiest and least expensive way to get divorce or legal separation?

My husband and I are not working out. He has "broken up" with me minus the divorce. Right now I am contemplating getting a legal separation since i don’t believe in divorces. Is there any way i can obtain it without having to pay so much out of pocket money to get it? I know our legal separation wont cause a nasty fight between us since we have already divided our assets.

O and I live in CA. i don’t know if that information makes a difference.

How does the divorce work in AZ if one party cheated?

I’m not quite sure how divorce works in the state of AZ. Like if people have to split assets, etc. Alimony, stuff like that. But what if one party cheated, do they still get half? Could they get alimony? What if they technically got their half of the person’s stuff already? Etc. Could someone point me in the right direction, don’t say an attorney, becuae I’m not the one getting divorced, they will give me no information.

Can US citizens who got married in Italy file a divorce in California?

Two US citizens got married in Italy, but never filed marriege in the US. Now we are trying to figure out the fastest way to file a divorce. Would that be filing a divorce in California where we both reside? In such a case, do we still have to divide our assets and property into half?

How do I take money out of a bank account and hide it before a divorce?

I have accumulated a nice amount of assets simply by saving and investing. Some of it before I got married, some while married. Now I want to divorce but don’t want her to get half of the funds. We have a joint account that has a little bit of money that I don’t mind splitting with her, but my personal funds I want to hide. There are obviously records of what is in there today, and will be records of any withdrawals I make between now and the divorce. I was thinking about withdrawing the funds, purchasing gold or high valued coins, and storing them in a safety deposit box listed in my mother’s name. During the divorce will I be held accountable for funds that were once in my personal account but are now gone? Does anyone have a better idea on how to move the funds out of my accounts and out of the site of the divorce laywers? PS – she doesn’t know I am planning on divorcing her yet. I want to figure out this money thing first. Please help.

The husband is in california and the wife is in PA. Both want a divorce as they’ve been separated for over 20 years. The wife is unable to travel.

You should know that state family law includes equitable distribution for assets. Equitable distribution means the judge uses certain factors to judge how the property will be split fairly and not necessarily equally. These types of factors include personal income, age, and who is responsible for the children.

To ensure a proper settlement and in order for your lawyer to be most helpful, you need to know all your investments and whether they are marital or separate. Getting this data for your attorney will make their job simpler and they can focus on more critical things such as filing all the documents and determining what to do if the other party contests the division of assets. It is best to try to settle with your spouse so you can both get things you want or be compensated how you see fit. If not a judge will do this for you and the results might be devastating.

A friend has an unusual inheritance problem in Argentina. His wife was Argentine and died. Her father died a few years earlier and the mother is still alive, but probably not for long. The man had two children, my friends wife and a son.Each of those produced ONE grandchild. Suspicious people feel the son is trying to get and hide the fathers wealth. Everyone in that family are very secretive about money, except to say they do not have one peso.The father who died could have left nothing more than a home, and his son says unpaid taxes make this expensive home worthless. The dead father claimed he "lost" two big businesses when Peron and his latest wife came back to Argentina and ruined the economy. The father has no will. Friend needs to know if his daughter should have an inheritance and exactly what assets there are. This must be done without cooperation of the dead father’s wife, nor of the son. There may be other people or records that could be helpful. Is this work for a lawyer?

pretty straightforward, no kids or assets involved and both parties willing to sign ..and i wuld like this done asap bcoz my boy-friend just proposed…please help….and also i purchased the pre-done divorce forms online and wanted to do it myself but the forms look so complicated…is it better to do it myself or hire a lawyer? anyone bn here before?

I have a friend who wants to get a divorce, He lives in MA. and the wife in CT. Three children, the child support has been established by the court for the past 3 years. What he wants to know is this, can he get a simple divorce online ? There are no assets to speak of at all on either side. Would an online, simple divorce work?
