I am trying to get a divorce.?
I am currently trying to get a divorce. I tried to do the uncontested divorce online, but since I have a restraining order, I cannot get an uncontested divorce. My husband is not contesting the divorce. In a nutshell he is in jail for drugs, and a domestic violence charge against me. I want to get this going since I can serve him the papers in jail. If he gets out I do not know, nor do I want to know where is he will go. We do have three children together, but I do not see any problem with him as far as custody. I mean he is in jail. At this time there is no way I can afford a traditional attorney. He took everything I had. I am just now getting back on my feet, but really want to get this divorce taken care of. If anyone can point me in a direction, I live in the southern california area and need to find someone to file the papers for me. Any help would be appreciated.

Alot of attorneys will work with you on a payment plan, contact your local women’s shelter and ask them who they use.

You need to contact your local battered women’s shelter – they have legal & other resources for women in your situation – they are usually found in your phone book

you could talk to a paralegal they are sometimes cheaper or you could go get a divorce kit from one of the stationary stores fill out the papers yourself and just pay the filing fees but either way you are going to have to pay the fees for filing the papers
You could also apply for legal aid in your area. They May be able to help you and work with you on a schedule as far as payment goes i’m not sure what your income is but those are a few options are available to you

They most likely have free counseling id look in the paper to see if thats the case.

Legal- Aide. It should be in the phone book, if not go to the wel-fare office and they will be able to give you more information.

Hi. I do not know about California law, but go to the public library and get a self-help divorce book. It has papers for a do-it-yourself divorce. Please read all papers to make sure that you have the exact papers that you need. Copy them and file for the petition and then copy all of the papers for him to notarize while he is in jail. He can get someone in the jail to notarize them for him. You notarize a copy before you send the papers to him and when he mails the papers to you, you file them with the court. Make sure that you put a self-addressed envelope with a stamp so that only thing that he has to do is to notarize the papers and put the papers back in the envelope and mail them asap back to you. The book should have custody, medical, and every thing else that you need to make sure that every thing is taken care of including his bills to stay his bills and your bills to stay your bills. Make sure to read every paper and every line to make sure that you agree with what will happen after the divorce is finalized. Make sure that you get a hearing date to go back to the court to file for other necessary papers. Hope this helps.

You can always go down to the local court house and try to get a fee waiver. Also call around you may be able to get an attorney to go pro bono until after the case. because there is domestic violence involved he by law has to pick up attorney fees. (with the right lawyer.) Also try to look into legal aid. Thats for low income family. Good Luck and God Bless.

Don’t go through a lawyer, use a paralegal. My divorce cost $200. If he is in jail, he will be served in jail.
You can also get the divorce papers for free online and fill them out yourself. There is a filing fee, but it’s not that much.


Call Legal Aid and see if they can help you.
