Divorce Lawyer?
Hello,
I need help before I see a lawyer. I bought a property under my mom’s name about 3 years ago. My mom is getting divorce in a few months and I wouldn’t like my property to harm her when they separate their properties( they have 3 more properties). Can I do a quitclaim deed to my name before she initiates the divorce?. Please help me !

If it is solely in her name she can quit claim it to you as a gift…
I am not a lawyer, but this is my understanding… you could probably speak with a lawyer to get advice… most will do a free consult…

She can quitclaim the property to you, BUT, if her husband (whom I’m assuming is not your Dad, cause I’m sure he wouldn’t do this to you) wants to be difficult, he can claim that she is divesting assets to third parties to protect them from him. In a divorce, many times the judge will order couples not to sell or transfer property, or spend any large amounts, etc.
So, hopefully your Mom’s husband knows that the property is indeed yours, and won’t have a problem with it.
