Divorce Jurisdiction
Generally, the State of California will have jurisdiction over the case in the event that one of the parties has been a resident of the State of California for at least six months immediately prior to the filing of the Petition for Dissolution of Marriage, and a resident of the county in which the divorce is to be filed for at least three months immediately prior to the filing of the Petition for Dissolution of Marriage. It should be noted, however, that California’s divorce jurisdiction may not be adequate or substantial enough in order to achieve some court orders if one the parties to the action has not had sufficient contacts with the State of California.
