Can my Lawyer represent my sister in law with her divorce to my brother? Conflict of interest?
Hi! I was wondering if my lawyer who I have used for several years for several different cases can represent my sister in law in her divorce custody case against my brother? Isn’t it some sort of conflict of interest or not? It kind of makes me mad because I need my lawyer now for another case and I am so upset because he is fighting against my brother. I don’t even know if he realizes what the situation is because we all had the same last name? I appreciate your comments. Thank you in advance.

No, its not a conflict of interest unless he represented your brother in the past or if he gained inside knowledge of that suit during his representation of you. But its not a conflict to take on cases that make your current clients angry.
Here’s the link to the American Bar Association’s model rules of professional conduct: http://www.abanet.org/cpr/mrpc/mrpc_toc.html. You want rules 1.7 and 1.8.
