California divorce law ?
Husband finds out about wife’s affair Aug. 2008. Gets mad and throws her out. She moves in with daddy. Husband waits until Feb. 2009 and files for legal separation. Questions : Why not file for divorce? Why legal separation? Is there any advantage either way? How long will it take for her to be divorced? She now has some mooch boyfriend living at daddy’s house. Can husband sue the boyfriend?

In California you have to file for legal separation first – it’s considered a cooling off period in case you change your mind. Once the period has ended you file for divorce, and the divorce is final six months after the decree is granted – one cannot remarry until the divorce is finalized.
If you want a quickie divorce, Nevada still has quick divorces but one has to establish residence for six weeks. Alnd I believe you can get quick ones in the Dominican Republic – but note foreign divorces can be sticky and in some instances have been questioned.
