Are BHA and BAS taxable income and can they be used to determine child support in the state of texas?
Also in the divorce we offered him visitation to see his son and hes denied it he wants nothing to do with him, that was not my decision, does that mean he doesnt have to pay child support? My lawyer contacted a military family law lawyer and she is my witness in this divorce and she specializes in mypay and child support, she says he will have to pay 2 a month if the judge agrees but my ex doesnt want that he wants no visitation and to only pay 0 a month, that doesnt cover anything. My witness (military lawyer) says BAS and BAH are considered in determining child support, my ex went an got an affidivat saying that its not taxable income. I’m so confused which one is right? 0 does nothing for my son.
First off Im not bumming off him, he cheated on me at 5 months pregnant and has made his current girlfriend pregnant. He wanted the divorce I want him to be around his child/ Im his 2nd wirfe and baby, and you didnt answer my question rudeass. He doesnt want to pay anything and the military law lawyer says im entitled to 763. Just because he doesnt want my son doesnt mean he cant help support himl.

First $270 is a lot more then some parents get However lack of visitation does not lower the child support.

bah goes away the second your divorce is final
bas was never for you your not entitled to it
be glad he is willing to send 270 a month
many women get nothing
find a job and be grateful for what you have
you divorced him you made your choice now deal with it no more free room and board
he doesnt have to pay all your bills and support you anymore he divorced you
and stop reasking the answers wont change

Because it’s not taxable income doesn’t mean it’s not income. The court bases child support on your income before taxes anyway.


His BAH and BAS aren’t taxable when he gets them in his checks, but for child support calculation it’s up to the state you’re in as to whether it is counted as income for child support.
Keep in mind, once he’s divorced he might not be entitled to BAH anymore.
What’s his pay grade?
I’d say the average amount I’ve seen as ordered child support for E-4′s and below to be between $200 and $300 per month for one child.
The average I’ve seen for E-5 and up is around $400 to $800 per month for one child.
